Welcome to JudaicaLev. By accessing and using our site, you agree to these General Terms and Conditions of Use and Sale (hereinafter "GTC"). We encourage you to read them carefully before placing any order.

1. Preamble and Purpose

These General Terms and Conditions of Use/Sale govern (i) the use of the website accessible at https://www.judaicalev.com (hereinafter "the Site") and (ii) the sales of products offered for sale on this Site between the publisher (hereinafter "JudaicaLev", "we") and any individual or legal entity (hereinafter "the Customer", "you") wishing to make a purchase.

These terms and conditions apply to all orders placed on the Site. Placing an order implies the Customer's full and unreserved acceptance of these General Terms and Conditions of Use/Sale.

Using the Site and placing an order implies full and complete acceptance of these Terms and Conditions of Use/Sale in effect at the time of the order.

JudaicaLev reserves the right to modify these Terms and Conditions of Use/Sale at any time. The new conditions will be applicable as soon as they are published online. Orders in progress remain governed by the Terms and Conditions of Use/Sale in effect at the time of their validation.

4. Site Access

The Site is accessible 24 hours a day, 7 days a week, subject to force majeure or events beyond our control (outages, maintenance operations, etc.).

JudaicaLev cannot be held liable for interruptions, slowdowns, or failures of the Site or the Client's internet connection.

Special Provisions for Shabbat and Jewish Holidays: Our operations are suspended from Friday afternoon to Saturday evening (Shabbat) as well as during Jewish holidays. During these periods, orders are not processed and customer service is unavailable. Orders placed during these periods will be processed as soon as operations resume.

5. Creating a Customer Account

Creating a customer account is optional for placing orders but makes it easier to track your purchases.

When creating an account, you agree to provide accurate, truthful, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials. Any use of your account will be presumed to have been made by you.

JudaicaLev reserves the right to suspend or delete any account in the event of a violation of these Terms and Conditions, proven or suspected fraud, or behavior contrary to accepted standards of morality.

6. Products

6.1 Product Description

The products offered on the Site are described as accurately as possible. Essential characteristics (dimensions, materials, weight, capacity, etc.) are indicated on each product page.

As many of the products are handcrafted (Judaica, jewelry, Jewish art, etc.), slight variations in color, finish, or pattern may exist between the image shown and the delivered product, without this constituting a defect.

6.2 Availability

Product offers are valid as long as they are visible on the Site and while stocks last.

In the event of unavailability after ordering, JudaicaLev undertakes to inform the Customer as soon as possible and to offer either a full refund, an equivalent product, or a delayed delivery.

6.3 Photos and Illustrations

Product photographs and illustrations are for illustrative purposes only. They are not contractual. Colors may vary depending on your screen settings.

7. Prices

Prices displayed on the Site are indicated in ₪ (€, $, ₪) according to the Customer's selection.

The Customer can change the display currency in the menu provided for this purpose.

7.1 Price Composition

Prices are shown excluding taxes (HT)> or all taxes included (TTC) as indicated. Prices do not include:

  • Shipping and delivery costs (calculated and displayed before order confirmation);
  • Any customs duties and import taxes applicable in the destination country (payable by the Customer — see article 11);
  • Any bank transaction fees charged by your bank.

7.2 Price Changes

JudaicaLev reserves the right to change its prices at any time. Products will be billed based on the price in effect at the time the order is confirmed, subject to availability.

8. Orders

8.1 Ordering Process

To place an order, the Customer follows these steps:

  1. Selecting products and adding them to the cart;
  2. Validate the cart;
  3. Login (create an account or check out as a guest);
  4. Choosing the delivery method;
  5. Choosing the payment method;
  6. Accepting these Terms and Conditions;
  7. Confirming and paying for the order.

An order confirmation is sent by email to the address provided by the Customer. This confirmation constitutes JudaicaLev's acceptance of the order and the sales contract between the parties.

8.2 Order Refusal

JudaicaLev reserves the right to refuse any order, particularly in the event of:

  • a pre-existing dispute with the Customer;
  • previous payment default;
  • a clearly fraudulent order;
  • abnormally high quantities;
  • the product's long-term unavailability.

8.3 Proof of Transaction

The computerized records stored in our systems constitute proof of orders, payments, and communications between the parties.

9. Payment

9.1 Accepted Payment Methods

The accepted payment methods are:

    • Credit card (Visa, Mastercard, American Express);
    • PayPal;

9.2 Payment Security

Online payments are secured by the SSL/TLS protocol. Bank details are never transmitted unencrypted over the network and are not stored on our servers. They are processed exclusively by our PCI-DSS certified payment provider.

9.3 Payment Confirmation

The order is considered effective only after confirmation of payment by our banking provider. In case of payment refusal, the order is automatically canceled.

9.4 Invoicing

An electronic invoice is sent to the Customer by email to the address provided during the ordering process. It is also available in their customer account.

10. Delivery

⚠️ IMPORTANT — Shipping from Israel: All our products are shipped from Israel. International delivery times vary depending on the destination country. The Customer may be subject to customs duties, import taxes, and clearance fees, which are their sole responsibility (see article 11).

10.1 Delivery Areas

10.2 Delivery Times

The following are the estimated delivery times from the date of shipment:

Delivery times are excluding Shabbat, Jewish holidays, and public holidays in the destination country. An additional period may apply in the event of delays by carriers or customs services.

10.3 Order Preparation

Order preparation time before shipment is generally 1 to 3 business days, excluding Shabbat and Jewish holidays.

    • For special order products (engravings, personalizations), an additional delivery time is indicated on the product page.

10.4 Delivery Costs

Delivery costs are calculated based on weight, volume, destination, and the chosen delivery method. They are displayed to the Customer before final order confirmation.

10.5 Delivery Tracking

A tracking number is sent to the Customer by email as soon as the order is shipped. The Customer can track their package on the website of the indicated carrier.

10.6 Receiving the Package

The Customer (or its recipient) must verify the conformity of the goods delivered at the time of delivery. In the event of any anomaly (damaged or opened package, missing items), it is the Customer's responsibility to:

    • note specific reservations on the carrier's delivery slip;
    • refuse the package if its condition is clearly compromised;
    • inform us within 3 business days following delivery at [sebastien.dan.partouche@gmail.com], attaching photos.

Without reservations made within this timeframe, the goods are considered accepted as is.

10.7 Delivery Failure

In the event of a delivery failure attributable to the Customer (incorrect address, prolonged absence, refusal to collect the package from the collection point), the Customer will be responsible for the reshipment costs. If the package is returned to us, the order will be refunded after deducting the return shipping costs.

11. Customs Duties, Import Taxes, and VAT

⚠️ Important: Orders shipped from Israel to another country may be subject to customs duties, import taxes, and clearance fees. These costs are entirely the responsibility of the recipient and are not included in the displayed price or delivery charges.

The applicable rules vary depending on the destination country:

  • European Union: Since July 1, 2021, all packages from non-EU countries (including Israel) are subject to VAT from the first euro, as well as potential customs duties on amounts exceeding €150.
  • United States: Exemption below a legal threshold (subject to change). Beyond this, import duties may apply.
  • Other countries: conditions according to local legislation.

Customers are advised to check with their country's customs authorities before placing an order to estimate these fees. JudaicaLev cannot be held responsible for customs duties and taxes applied by the destination country, nor for any delivery delays related to customs clearance.

If the Customer refuses to pay these fees to the carrier or customs, and the package is returned to JudaicaLev, the refund will be issued after deduction of the round-trip shipping costs and any other expenses incurred.

12. Right of Withdrawal

12.1 Withdrawal Period

In accordance with applicable European regulations (Directive 2011/83/EU), a non-professional customer residing in the European Union has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide any justification or pay any penalties.

12.2 How to Exercise This Right

To exercise this right, the customer must notify their decision to withdraw before the expiry of the withdrawal period, by email to [sebastien.dan.partouche@gmail.com] or by mail to the return address provided. The Customer may use the standard form provided in the appendix or write a clear statement. The product must then be returned in its original packaging, complete, in perfect condition, and with all its accessories, within 14 days of notification. 12.3 Return Costs Return shipping costs are the responsibility of the Customer. Given the shipping from Israel, these costs can be significant, and we recommend tracked and insured shipping.

12.4 Refund

Refunds are issued no later than 14 days after receipt of the returned product and verification of its condition, using the same payment method used for the order, unless otherwise agreed by the Customer.

12.5 Exceptions to the Right of Withdrawal

In accordance with the law, the right of withdrawal cannot be exercised for:

  • personalized or custom-made products (engravings, embroidery, mezuzah scrolls);
  • products unsealed after delivery that cannot be returned for hygiene or health protection reasons (opened Dead Sea cosmetics, for example);
  • foodstuffs (kosher, coffee, tea, spices, etc.) ;
  • Unsealed audio or video recordings or software;
  • Unsealed books.

13. Guarantees

13.1 Legal Guarantee of Conformity and Guarantee Against Hidden Defects

Regardless of any commercial guarantee, JudaicaLev applies the legal guarantees provided by applicable legislation: legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code for Customers residing in France) and guarantee against hidden defects.

13.2 Guarantee

Commercial Warranty

Some products may be covered by a manufacturer's commercial warranty. The terms of this warranty are indicated on the product sheet or in the documentation accompanying the product.

13.3 Implementation

To benefit from a warranty, the Customer must contact us at [sebastien.dan.partouche@gmail.com], describing the problem precisely and attaching supporting documents (photos, copy of the invoice).

14. Intellectual Property

All elements constituting the Site (texts, photographs, illustrations, logos, trademarks, videos, databases, general structure, source code) are the exclusive property of JudaicaLev or its partners and are protected by intellectual property laws.

Any reproduction, representation, modification, publication, transmission, or distortion, in whole or in part, of the Site or its content, by any means whatsoever and on any medium whatsoever, is strictly prohibited without prior written authorization.

The use of all or part of the Site, in particular by downloading, reproduction, transmission, or representation for purposes other than personal and private use, is strictly prohibited. Any violation of these provisions will subject you to the penalties provided for by applicable law.

The Site may allow users to post reviews on products. By submitting a review or comment, you guarantee:

  • that the content is accurate, sincere, and based on your personal experience;

19. Limitation of Liability

JudaicaLev undertakes to exercise the utmost care in the performance of its contractual obligations.

However, JudaicaLev cannot be held liable:

    • in the event of force majeure (Article 21);
    • for indirect or intangible damages (loss of profits, loss of revenue, loss of business opportunity);
    • in the event of misuse of the products by the Customer;
    • in the event of inaccuracies in the information provided by the Customer (address, identity, etc.);
    • in the event of delays or non-performance due to third parties (carriers, payment providers, customs services).

In any event, and to the extent permitted by applicable law, JudaicaLev's liability is limited to the amount of the order in question.

20. Force Majeure

JudaicaLev shall not be held liable for any failure to perform or delay in performance resulting from a force majeure event, as defined by law and jurisprudence, including but not limited to: strikes, social conflicts, armed conflicts, political unrest, pandemics, natural disasters, failures of telecommunications networks, energy suppliers, carriers, or payment providers.

21. Compliance with theLaw

The Customer agrees to use the Site and the products purchased in accordance with the laws and regulations in force in their country of residence. JudaicaLev cannot be held liable for any non-compliant use by the Customer.

Certain products (books, parchments, religious objects) may be subject to specific import regulations in certain countries. It is the Customer's responsibility to verify the legality of importing them into their country.

24. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the law of:

In the absence of an amicable settlement, any dispute relating to the interpretation or performance of these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts, unless otherwise required by mandatory legal provisions.

For consumer Clients residing in the European Union, these provisions apply without prejudice to the mandatory provisions of the national law of the Client's country of residence.

25. Severability

If any provision of these Terms and Conditions is declared invalid or unenforceable by a competent court, the other provisions shall remain in full force and effect.

26. Acceptance

By checking the box "I have read and agree to the General Terms and Conditions of Use and Sale" when validating the order, the Customer acknowledges having read these Terms and Conditions of Use and Sale and accepts them without reservation.
